A bankruptcy lawyer is fortunately not necessary but in very special situations. If you are covered in debt and you have tried every thinkable possibility to get rid of it, then the time is in to consider a bankruptcy filing. The recent years as credit cards and other kind of consumer credit has been more and more available. The backside of this extended availability has been a huge increase in consumer’s debt. When higher rates of unemployment are added, the percentage of people that can’t pay their debt also has increased. For many people, bankruptcy is the only solution of their debt problems. This way, they can get rid of their debt problems once and for all and move on in their lives, instead of feeling the pressure of knowing that you owe other people money each and every day.

There are several roles a bankruptcy lawyer plays in the overall process of filing for bankruptcy. Choosing the wrong lawyer, or one without your best interests in mind, can not only cost you financially but could also affect your overall financial health for the next 10 years. A lawyer is more that someone who files papers; they are there to represent your interests in front of the court and in front of other creditors.

When you file for bankruptcy the process involves not only going before a judge to finalize the paperwork, but also dealing with creditors. A bankruptcy attorney is someone who is there to represent your interests before the court and the creditors. Creditors are only interested in getting money and will use every trick and loophole they can to get you to pay up. Without a qualified lawyer who is working on your behalf you could find yourself in deeper financial trouble than you were before filing. It is highly recommended and encouraged by the courts that you do not attempt to represent yourself in bankruptcy proceedings.

When choosing a lawyer be sure they are listening to you and understand your current situation. All too often many attorneys in this area are looking to move clients through as quickly as possible for the maximum amount of revenue. There are stories of some attorneys never even meeting with the client until they show up in court. Remember, we are talking about something that will be on your credit report for 10 years – spend the money to get an attorney who works for you, not for his own self interests.
